Applicability - Consumers Only
Boom Learning is a small business as defined by United States Small Business Administration. Your state's consumer law may not apply to our business based on our (a) business size, (b) the fact that we do not sell consumer personal information, (c) the fact we do not share consumer personal information without opt in consent for advertising purposes, or (d) the fact that FERPA or HIPAA may apply to the information in question.
There is a narrow class of consumer for who this notice may apply. That class consists of parent educators, who use Boom Cards with their own children, who live in a state where Boom Learning meets the thresholds for applicability of the state's consumer privacy law. This notice only applies to you if you are in a state with a consumer data protection law, that law classifies you as a consumer, and Boom Learning satisfies the thresholds for the law to apply. ("Consumers"). Those states may include, but are not limited to, California, Colorado, Connecticut, Florida, Illinois, Iowa, Michigan, Nevada, Oregon, Texas, Utah, Virginia, and such other states as pass and put into effect consumer privacy protection laws.
This notice does not apply if you are
- A student user,
- A managed adult user (part of a business account),
- Purchasing individually for business use (including HIPAA and FERPA uses).
If you are a student or parent or guardian of a student who has been assigned by an account holder to use Boom Learning, you must contact the account holder for help. They can contact us.
What Consumers Need to Know about Categories of Data and Who We Share With
Everything in our General Privacy Notice and all supplements apply to this policy. Our Data Elements details the categories of data collected. You can find information about who we share information with and the agreements we have with them in

We cannot serve you if you tell us we cannot use our subprocessors.
Managing Sensitive Personal Information
Sensitive Personal Information is information that could be used to find and/or harm an individual. It includes, but is not limited to.
- User credentials such as usernames and passwords
- Biometric data and genetics
- Ethnic or racial origins
- Precise geolocations
- Religious or philosophical beliefs
- Information about a consumer’s sexual orientation, sex life, or health
- Contents of a consumer’s text, mail, and email
- Driver’s license numbers
- Social Security Numbers (SSN)
- State ID numbers
- Union membership
- Passport numbers
Other than user credentials, few Consumers will use Boom Cards to collect or display Sensitive Personal Information. However, we know that Consumers might use the Boom App to teach children information about themselves that is sensitive. If you as a Consumer gather Sensitive Personal Information about a child, you are consenting for us to process the sensitive information. You are promising us that you have legal authority and consent to gather that information. It is up to you to look at the materials before you assign them. You can delete reports logs which effectively deletes any Sensitive Personal Information collected by a log, if any.
We show any data collected about a child to all linked adult users. If you use Colleagues to share your child with a teacher or tutor, all teachers and tutors with whom you share that child can see how well the child did with any purchased Boom Cards deck or any private deck shared with the applicable teachers or tutors. Do not share your child unless you are willing to share all the information associated with the child. You can revoke Colleagues in app.
Exercising Your Consumer Rights
What you should know:
- Using Fastplay Pins will prevent data collection and storage.
- We will not discriminate against you for exercising your legal rights.
- We earn money only from the sales of Boom Cards and memberships.
- We do not sell your personal data.
- To keep your records, you may export reports using .pdf or by copy-paste to Excel.
- You can delete data yourself.
- We will delete data as described in our General Privacy Notice.
If we sell Boom Learning or merge it with another company, your information will be part of that sale or merger. That new company takes on all our obligations to you. If this happens, we will let all users know. We will also give you the chance to delete your information before we transfer any rights of access to the data to the new business owner.
From time-to-time we receive requests to our customer service desk that seek to exercise these rights. Most requests are for accounts excluded from this Consumer Privacy Protection notice. If you need help exercising your rights you may contact us. You may have an agent contact us. We will require proof that the agent is authorized to act on your behalf. If you refuse to engage in self-help we will require proof of identity and connection to the account before acting on your request. If you are not happy with the results you may ask to appeal the decision of the agent to the HelpDesk Manager/Legal. We will provide a written statement of our decision. You may have rights to contact your state Attorney General if you are not satisfied with the outcome of your appeal.
We Don't Profile Our Users
The information we gather about you in the Boom App is used to deliver the Boom App. We do not engage in profiling for automated decision purposes. All participation in advertising is opt-in. See our Privacy Policy for our Marketing Properties.
